Article 1 – Definitions

In these terms and conditions:

Grace period: The period within which the consumer can exercise his right of withdrawal;
Consumer: the natural person not acting in the exercise of professional or business and a distance contract concerned with Safeways-helmets.com ;
Day: calendar;
Duration transaction: a distance contract concerning a series of products and / or services, the supply and / or purchase is spread over time;

Article 3 – Applicability

These terms and conditions apply to every offer of Safeways-helmets.com and any agreement concluded at a distance between businesses and consumers.

Before the distance contract is concluded, the text of these general conditions made available to the consumer. Article 4 – The offer

Article 5 – The contract

1. The agreement is subject to the provisions of paragraph 4, concluded at the time the consumer accepts the offer and meet the corresponding conditions.
2. If the consumer has accepted the offer electronically, Safeways-helmets.com will immediately confirm electronically receipt of acceptance of the offer. Until receipt of this acceptance has not been confirmed by Safeways-helmets.com, the consumer may terminate the contract.
3. If the contract is concluded electronically, Safeways-helmets.com will take appropriate technical and organizational measures to protect the electronic transfer of data and he will ensure a secure web environment. 4. Safeways-helmets.com can – within the law – to inform or consumers of its payment obligations, and all facts that are important to a sound conclusion of the distance contract and factors. 6. In the event of an extended transaction is the provision in the preceding paragraph shall apply only to the first delivery.

Article 6 – Right of withdrawal

1. In The consumer has the right to cancel his order within 24 hours after concluding the contract. Safeways-helmets.com will repay the amount of the pre-payment within 30 days.
2. 24 hours after concluding the contract the consumer cannot withdraw the order anymore, Safeways-helmets.com is entitled to deviate from the standard rules and regulations reflecting this matter, because orders to produce the product:

  • Safeways-helmets.com has been instructed to produce according the specific specifications of the consumer
  • The product has clearly a personal nature
  • By its nature this product cannot be used by another client

Article 7 – The price

1. The prices of the products and / or services during the period mentioned in the offer will not be increased, except for price changes due to changes in VAT rates.
2. The business products or services whose prices notwithstanding the preceding paragraph are subject to fluctuations in the financial market over which Safeways-helmets.com has no influence, with variable prices. These fluctuations and the fact that any price targets, are stated in the offer.
3. Price increases within 3 months after the conclusion of the contract are only allowed if they are the result of legislation or regulations.
4. Price increases from 3 months after the conclusion of the agreement only permitted if Safeways-helmets.com stipulated as much and:

they are the result of legislation or regulations; or

the consumer has the power to terminate the contract as of the date the increase takes effect.

5. The supply of products or services mentioned prices include VAT.

Article 8 – Conformity and Guarantee

1. The company guarantees that the products and / or services comply with the contract, the specifications stated in the offer, the reasonable requirements of reliability and / or usefulness and, at the date of conclusion of the agreement existing legal provisions / or government regulations. If agreed, Safeways-helmets.com also means that the product is suitable for other than normal use.
2. A guarantee provided by Safeways-helmets.com, manufacturer or importer does not affect the legal rights which the consumer can do under the contract against Safeways-helmets.com funds.

Article 9 – Delivery and execution

1. Safeways-helmets.com will take the greatest possible care in the receipt and execution of orders and products in assessing applications for the provision of services.
2. The place of delivery is the address that the consumer makes known to the company.
3. Subject to what is stated in Article 4 of these terms and conditions, the company will implement accepted orders expeditiously but not later than 30 days unless a longer period is agreed. If delivery is delayed, or if an order is not or only partially, the consumer receives them no later than 30 days after the order was placed. The consumer in this case has the right to terminate the contract without penalty and be entitled to any compensation.
4. In case of dissolution in accordance with the preceding paragraph, the consumer will be paid as soon as possible but no later than 30 days after repudiation.
5. If delivery of an ordered product proves impossible, endeavour to provide a replacement article. Will be reported later than the delivery in a clear and comprehensible manner that a replacement item is delivered. The right of withdrawal cannot be excluded with replacement products. The cost of return shipment are borne by Safeways-helmets.com .
6. The risk of damage and / or loss of products rests upon Safeways-helmets.com up to the moment of delivery to the consumer or a pre-designated and to Safeways-helmets.com , unless this is expressly agreed.

Article 10 – Payment

1. Safeways-helmets.com will only accept orders after the consumer has completed the electronic order procedure and the advance payment funds effectively reached the bank account of Safeways-helmets.com.
2. Because advance payment is compulsory the consumer cannot claim any right to an order until such time as the advance payment has been received.
3. The consumer has the duty to inaccuracies in the payment details immediately to the operator.

Article 11 – Intellectual Property

1. Once the electronic order procedure has been concluded by the consumer and a design has been offered to Safeways-helmets.com for production of a helmet the consumer can no longer claim an exclusive (intellectual property) right to this design. The consumer clearly authorizes Safeways-helmets.com to use this design for publication purposes – if Safeways-helmets.com wishes to do so.
2. The consumer is obligated not to offer Safeways-helmets.com any design from which the consumer knows or could know that this could be an infringement to the (intellectual) property right or brand or trademark of a third party.

Article 12 – Complaints

1. Safeways-helmets.com has a well-publicized complaints instruction and deals with complaints under this procedure.
2. Complaints about the performance of the contract must be submitted to Safeways-helmets.com, after the consumer has found the defects. Set promptly, fully and clearly.
3. When Safeways-helmets.com receives complaints, she undertakes within a period of 14 days from the date of receipt to answer. If a complaint is a foreseeable longer processing time, answered by the operator within the period of 14 days with an acknowledgment of receipt and indicating when the consumer can expect a more detailed answer.
4. If the complaint cannot be resolved by mutual agreement creates a dispute that is subject to dispute.

Article 13 – Disputes

Contracts between Safeways-helmets.com and the consumer of these terms refer to Dutch law applies.

Article 14 – Additional or different terms
